Terms and Conditions

Please read the following carefully. These policies apply to Kamil Store Italia and may be updated from time to time.

These Terms and Conditions govern your use of the Kamil Store Italia online shop, orders, and related services.

1. Scope and operator

This website is operated by Kamil Store Smartphone by Ehsan Kamil (VAT IT07299410485), Pontedera (PI), Italy. By browsing, registering, or placing an order you accept these terms.

2. Account and eligibility

You must provide accurate registration details and keep your credentials secure. You are responsible for activity under your account. We may suspend accounts used for fraud, abuse, or violation of these terms.

3. Products, prices, and orders

Product descriptions, images, and prices are shown in the selected currency where available. An order is confirmed when you receive an order confirmation. We may cancel or refuse orders in case of stock unavailability, pricing errors, or suspected fraud.

4. Payment

We accept the methods shown at checkout: card, PayPal, bank transfer, and instalment plans through Klarna. Card and instalment payments are handled by our payment providers; full card details never reach our servers. An instalment plan is an agreement between you and that provider, subject to their approval and their terms, and any fee they charge is shown before you confirm the order. Prices include VAT where applicable. Orders paid by bank transfer are dispatched once the funds have cleared.

5. Delivery and collection

We ship throughout Italy with tracked delivery. The standard shipping cost, the free-shipping threshold, indicative delivery times and free in-store collection are described on the Shipping, returns and warranty page (/spedizioni-e-resi); the amount charged on your order is always shown at checkout before you confirm. Orders paid by bank transfer are dispatched once the funds have cleared.

The risk of loss of or damage to the goods passes to you when you, or a third party you designate other than the carrier, take physical possession of them (art. 63 of the Italian Consumer Code).

6. Right of withdrawal

If you are a consumer you may withdraw from a distance contract, without giving any reason and without penalty, within 14 days of the day on which you, or a third party you designate other than the carrier, take physical possession of the goods (arts. 52-59 of the Italian Consumer Code, Legislative Decree 206/2005). If an order includes several items delivered separately, the period runs from delivery of the last item.

To withdraw, send us a clear statement within that period to info@kamilstore.it or through the other contact details on the site. You may use the model withdrawal form published on the Shipping, returns and warranty page (/spedizioni-e-resi), but you do not have to. Then return the goods within 14 days of telling us, with all accessories and documentation. You may handle the goods only as far as necessary to establish their nature, characteristics and functioning; you are liable for any diminished value resulting from other handling.

We refund all payments received from you, including standard delivery costs, without undue delay and in any event within 14 days of the day we are informed of your withdrawal, using the same means of payment you used unless agreed otherwise, at no cost to you. We may withhold the refund until we have received the goods back or you have supplied proof of having sent them, whichever is earlier. The direct cost of returning the goods is yours, unless the product is faulty or not as described.

The right of withdrawal does not apply in the cases listed in art. 59 of the Consumer Code, including goods made to your specifications or clearly personalised, sealed audio or video recordings and sealed software unsealed after delivery, and digital content not supplied on a tangible medium once supply has begun with your express consent and acknowledgement that you lose the right. It does not apply to purchases made with a VAT number for business purposes.

7. Legal guarantee of conformity

For goods sold to consumers, Kamil Store is liable under arts. 128-135-septies of the Italian Consumer Code (Legislative Decree 206/2005, as amended by Legislative Decree 170/2021) for any lack of conformity that exists at delivery and becomes apparent within:

• 24 months of delivery, for new products; • 12 months of delivery, for used and refurbished products. For second-hand goods the law allows a shorter period to be agreed, of no less than one year; that is the period stated on the product page and in section 8.

Unless proven otherwise, a defect that becomes apparent within one year of delivery is presumed to have existed at delivery. If the goods are not in conformity you are entitled, free of charge, to have them brought into conformity by repair or replacement or, where the law provides, to a proportionate price reduction or to terminate the contract. The defect must be reported within two months of discovering it.

The legal guarantee is in addition to any manufacturer's warranty (commercial guarantee), which neither replaces nor limits it and which you can claim directly from the manufacturer on its own terms.

How to claim: email info@kamilstore.it, call or WhatsApp +39 350 999 9989, or visit one of our shops (Pontedera, Via I° Maggio, 13, 56025 Pontedera (PI); Pisa, Lungarno Mediceo, 54, 56127 Pisa (PI)), quoting your order number or attaching proof of purchase and describing the fault. We will tell you how to bring or send the product; for defects covered by the legal guarantee, shipping, repair or replacement costs are paid by us. Before handing over a device, back up your data and turn off account locks (for example "Find My iPhone").

The guarantee does not cover damage caused by misuse, drops, liquid, unauthorised repairs or normal wear, nor characteristics you were aware of at purchase, such as the cosmetic marks described by a used device's grade. Repairs carried out by Kamil Store are guaranteed for 12 months.

The Consumer Code's legal guarantee applies to consumers, meaning individuals buying for purposes outside their trade, business, craft or profession. Purchases made with a VAT number are covered by the warranty against defects in arts. 1490 et seq. of the Italian Civil Code.

8. Used and refurbished devices

Used and refurbished devices are sold tested and graded. Each listing states its grade and the cosmetic condition that grade describes; photographs illustrate the grade rather than the individual unit unless a listing says otherwise. Battery wear, light marks, and other signs of use consistent with the stated grade are not defects. Used devices carry a twelve-month warranty of conformity, the shorter period permitted for second-hand goods under Italian law. Accessories supplied with a used device may be compatible equivalents rather than original sealed packaging, and the listing says so where that applies.

9. Repairs and trade-in

Repair bookings and trade-in valuations are quotes, not final prices. A repair quote may change once we open the device; we contact you for approval before doing any work beyond the quote. A trade-in offer is based on the condition you declare and is confirmed after we inspect the device — if it differs from your description we send a revised offer, which you are free to refuse and have the device returned. Back up your data before handing a device to us: we are not responsible for data left on a device, and repair or refurbishment may erase it.

10. Liability and governing law

To the extent permitted by law, Kamil Store Italia is not liable for indirect damages. Mandatory consumer protections remain unaffected. These terms are governed by Italian law; the courts of Pisa have jurisdiction where permitted, without prejudice to mandatory consumer venues.
